Terms and conditions

1. Tour Operator

1.1. The motorbike tours are operated by Classic Motorbike Tours Greece, situated at and operating from Tolo, Peloponnese, Greece.

2. Participant

2.1. The Participant is the person (Rider) listed on the booking form.

3. The Contract

3.1. The contract is signed between Classic Motorbike Tours Greece and the Participant by completing the online booking form and the booking confirmation by email by Classic Motorbike Tours Greece. The contract includes the acceptance and agreement by the Participant of these Terms and Conditions.

3.2. The Participant has to sign a liability release waiver including the agreements for the use of the motorbike provided by Classic Motorbike Tours Greece. This document will be signed prior the start of the first motorbike tour.

3.3. Classic Motorbike Tours Greece reserves the right to disallow any booking at their discretion.

4. Payment

4.1. The payment is due and payable prior the start of the first motorbike tour by cash payment. 

5. Pricing

5.1. The items listed in the “What is included” on the website of Classic Motorbike Tours Greece are included in the price.

The following items are therefore additional costs to the Participant:

· Airline tickets.

· Transfer from the airport to Tolo and vice versa.

· Personal travel, accident and medical insurance.

· Personal spending money, drinks, meals & dinners, entrance fees, and other extras.

· Personal documentation (e.g. passport, visas if required).

· Any other item not specifically included in the price.

6. Insurances

6.1. The motorcycle that Classic Motorbike Tours Greece provides to the Participant is not insured if the Participant caused damage to the motorcycle by his own fault. In circumstance of an accident caused by the responsibility of The Participant, the damage to the motorcycle has to be paid by the Participant up to a maximum of Eur. 2.000. The term damage is to exclude reasonable wear and tear. Minor damage caused by gravel, stones and insects are considered normal wear and tear, however damage caused by an accident, dropping a motorcycle or riding off-road is not considered normal wear and tear.

Because of our reduce policy The Participant has the possibility to reduce the above mentioned risk of Eur. 2.000 to an amount of Eur. 525 by paying an additional insurance fee of Eur. 20 per day.

6.2. The Participant is covered for material and physical damage to a 3rd party by a comprehensive liability insurance up to a maximum amount of Eur. 1.000.000.

6.3. Classic Motorbike Tours Greece does not offer travel insurances. It is there for highly recommended that the Participant will take an adequate travel insurance, including cover for medical treatment, accidents, repatriation and holidays cancellation.

6.4.  If the Participant travels without adequate insurance cover, Classic Motorbike Tours Greece will not be liable for any losses.

7. Tour Changes

7.1. Classic Motorbike Tours Greece is not liable for unpleasant weather conditions and no refunds will be made for such conditions.

7.2. The Participant accept that force majeure may prevent Classic Motorbike Tours Greece from supplying a tour as described and that Classic Motorbike Tours Greece will have no liability in this regard.

7.3. Classic Motorbike Tours Greece reserves the right to change a tour schedule. This may be due to several reasons, not limited to but including, war, adverse weather conditions, riots and or matters concerning the Participants safety or an operational circumstance such as bike theft or damage caused by an accident.

8. Tour Guide

8.1. The tours of Classic Motorbike Tours Greece are run by a Tour Guide. The decision of the Tour Guide is final on all matters likely to affect the safety of the Participant, including riding competency of the Participant, any change to itinerary due to unforeseen circumstances or the removal of the Participant from the tour.

8.2. If the Participant fails to comply with a decision made by the Tour Guide, or interfere with the well-being of the group, the Tour Guide may order the Participant to leave the Tour immediately, with no right of refund. In such circumstance, when a Participant is removed from a tour, Classic Motorbike Tours Greece accepts no responsibility for the return of the Participant to the start point of the Tour or any other costs incurred therein.

9. Cancellation by the Participant

9.1. If the Participant has to cancel a tour, Classic Motorbike Tours Greece must receive notice by email.

10. Cancellation by Classic Motorbike Tours Greece

10.1. Should Classic Motorbike Tours Greece have to cancel a tour for reasons beyond its control, Classic Motorbike Tours Greece will offer the Participant an alternative tour with the Participants agreement or a refund of the money paid.

10.2. When a tour has been cancelled by Classic Motorbike Tours Greece, Classic Motorbike Tours Greece will not be liable for additional costs or losses incurred by the Participant due to the cancellation of the tour. This includes, but is not limited to, the cost of airline tickets and hotel reservations.

11. Our Motorcycles on tour

11.1. The Participant is responsible for the ignition key of the motorcycle. Should it be lost or stolen due to neglect or failure to follow the Tour Guides instructions the Participant is responsible for the replacement to a maximum of EUR 250.

11.2. If the Participant operates a motorcycle after drinking alcoholic beverage or using mind altering drugs, then the Participant will incur unlimited liability for damage to the motorcycle. Classic Motorbike Tours Greece is not obliged to replace a motorcycle damaged by a participant in these circumstances.

11.3. The Participant who intend to operate a motorcycle provided by Classic Motorbike Tours Greece  must be at least 25 years old and must have a valid motorcycle operator licence for at least 5 years.

12. Participants Responsibilities & Obligations

12.1 The Participant must have in his possession during the tour the following documents which must be current and valid and are in respect of the motorcycle and the Participant

· Passport

· EU Citizens and Non-EU citizens: Up to date Driving (Riding) license of the Participants country of residence. In addition, Non-EU citizens must have an up to date International Driving Permit.

12.2. If a visa is required, it is the Participants responsibility to make all necessary arrangements to ensure compliance with visa requirements. We accept no responsibility whatsoever in the event that these matters are not dealt with prior to a tour start.

12.3. The Participant who is forced to curtail their participation due to incorrect, lack of, or loss of necessary documents will not be refunded.

12.4. The Participant(s) agree to accept the authority and decisions of the Tour Guide during a tour. If in the opinion of the Tour Guide your health or conduct appears to endanger the progress of the tour, you may be excluded from the whole or part of the tour.

12.5. The Participant agrees NOT TO:

· Use the motorcycle off-road unless under the guidance of Classic Motorbike Tours Greece.

· Park the motorcycle in a dangerous position.

13. Responsibilities by Classic Motorbike Tours Greece

13.1 Classic Motorbike Tours Greece is responsible for providing the services as presented in the tour descriptions.

13.2. Classic Motorbike Tours Greece take no responsibility for any flight delays or scheduled changes which as a result might cause the Participant to arrive delayed to the tour start or not show at all.

13.3. Classic Motorbike Tours Greece is not responsible for Participant’s personal effects if they are lost, stolen or destroyed.

13.4. Classic Motorbike Tours Greece is not responsible for any accidents. It is agreed and understood that Classic Motorbike Tours Greece is not the guardian of any customer safety and that Classic Motorbike Tours Greece can not be held liable in any way for any occurrence in connection with the tour which might result in injury, death or other damage to the customer or his property.

14. Force Majeure

14.1 Means any unusual and unforeseeable circumstances beyond our normal control, which the consequences of could not have been avoided even when exercising all due care. Such circumstances or events include, but are not limited to, war, or threat of war, riot, civil unrest, industrial disputes or strikes, unavoidable technical problems with transport, closure or congestion of airports, terrorist activity, natural disasters, industrial disasters, fire, theft, flooding and adverse weather conditions. In the event of any of the above, refunds or compensation payments cannot be made, nor can Classic Motorbike Tours Greece or any of their staff be held liable.

15. Complaints

15.1. If, in the opinion of the Participant, Classic Motorbike Tours Greece have not met its obligations it should first be brought to the attention of the accompanying leading Tour Guide, so that corrective action can be taken if possible. If however, the Participant is not completely satisfied, any further comments should be put in writing, within 21 days of your return, specifying the Tour identity and dates, and nature of the complaint and sent by email to Classic Motorbike Tours Greece. Your complaint will be investigated, and responded to in the first instance within 14 days. Failure to follow the procedure set out in this clause may affect the ability to investigate the complaint, and will affect the Participants rights under the contract.

16. Jurisdiction

16.1. The contract and all matters arising from it are subject to Greek law and the jurisdiction of the Greek courts. In the event that any of the provisions of this contract will be determined by any court to be invalid, unlawful or unenforceable to any extent then such provision will to that extent be severed from the remaining provisions of the contract, which will continue to be valid and enforceable.
